1. General


The purpose of these general conditions of sale is to govern the contractual relations between the company Digistore (RCS Strasbourg 451974125), whose registered office is at 11 rue Jacobi Netter 67200 STRASBOURG FRANCE, and the Customer defined below as being the user of the site and accepting these general conditions of sale.

All other conditions are only binding on Digistore after written confirmation from it. The information on this site is given for information only and may be modified by Digistore without notice. The mere fact of placing an order on the site implies the unreserved acceptance of these general conditions of sale.

2 – Products


The characteristics of the products offered for sale are presented on the site in the product sheets.
Photographs in situation with other materials and accessories do not enter into the contractual field. The appearance of a product having evolved without the manufacturer having updated the photos. It is also advisable to check the accessories provided in the description or the specifications because visuals in situation can be shown to see the use of a product within the framework of a complete configuration.

3 – Validity of sales offers and availability


The products are offered for sale while stocks last. For products that are not in stock in our warehouses, our offers are valid subject to availability from our suppliers and pricing conditions that have not changed.

For items that are not in stock, an availability period is announced subject to stock at the manufacturer or supplier. In the event of a supplier breakdown, we strive to obtain a deadline or an estimate which is communicated to the customer by email as soon as possible.

4 – Product prices


The prices appearing on this site are expressed in Euros and include all taxes (TTC) for the French version and excluding taxes (HT) for the foreign versions, excluding shipping costs (unless mentioned free delivery valid in metropolitan France and Monaco). Prices may be displayed in the foreign currencies present in the drop-down list at the top right of the site, for information only, in fact the rate of currencies changes rapidly, although in principle being updated once a day (under reserve of availability of the information servers), in all cases the conclusion of the order and the payment are made in Euro.
Prices may be changed at any time without notice.
To these prices, transport costs should be added unless otherwise stated, calculated according to the type of items ordered and the carrier selected by the customer. The shipping costs are specified at the bottom of the shopping cart and on the delivery method selection page, it is finally recalled in the summary of the order which precedes the validation.
The price is payable in cash on the day of the order. The prices charged are those applied at the time of the order within the limits of available stocks and subject to typographical error or modification of the French VAT rate. Any change in this rate would then be reflected immediately in the selling prices.

French VAT is not due for delivery addresses outside Europe or for companies in the European Union having provided the intra-community VAT number when creating the customer account, the validity of this number is checked. immediately.
Outside the European Union or in the DOM-TOMs, and according to the legislation in force in the country of delivery, customs fees, duties and taxes may be claimed by the local authorities from the customer and are the responsibility of the latter.

5 – Order and invoicing


If the customer wishes to place an order, he must first identify himself. To this end, he will complete, according to the instructions provided to him online, a form made available to him where he will include the information necessary for his identification and in particular his surname, first name, telephone number, postal address and delivery address. . Additional information may be requested later to ensure the quality and security of the delivery.

The customer having chosen the products presented, will definitively validate his order by clicking on the button “Validate order” to show his commitment and his acceptance of the General Conditions of Sale. From this moment, the order is registered, and an order number is communicated to the customer as well as a confirmation on the screen and by e-mail. The data recorded by Digistore constitutes proof of the nature, content and date of the order.
With regard to special orders, the products of which have been specially ordered for the customer, they cannot be canceled if the products have already been dispatched by the suppliers in question and cancellation is no longer possible.

A detailed invoice with the amount of VAT calculated on the total excluding tax and included in the total including tax is sent to the customer by e-mail or in his customer area, it can also be attached to the package.
The indication of the amount of the VAT gives the possibility to the communities, companies and liberal professions to recover it.

6 – Method of payment


The online store offers a wide choice of payment methods to meet the needs of its large clientele.

By bank card (Carte Bleue, Visa, Eurocard, Mastercard)
The validation of the order by bank card is worth mandate to pay the price including all taxes of the order.

Digistore also reserves the right to request proof of identity and proof of address for any first order placed on the site.

By bank transfer
When choosing the bank transfer, the IBAN parameters are specified and recalled in the order confirmation.
The customer then has a period of 7 days to make a transfer in payment of the total amount including VAT of the order (shipping costs included) or the order will be canceled automatically.
The order number must be specified in reference to the transfer.
When a transfer is made from abroad, all costs must be borne by the issuer.

By Paypal / American Express
The customer can identify himself and pay with his Paypal account or directly by card, in particular with American Express.

7 – Digipoint loyalty points

It is possible to earn digipoints loyalty points on the products concerned when specified on a product sheet. These points will be added to the digipoints balance of the customer account when an order concerned is dispatched. They can then be used as a partial or total deduction from the amount of a subsequent order. The balance of points cannot be refunded.

8 – Late payment


If the customer is a professional: pursuant to Article L. 441-6 of the Commercial Code, late payment penalties are payable the day following the payment date appearing on the invoice in cases where the sums due are paid after this date. The rate of these penalties is three times the legal interest rate.

9 – Delivery method


Delivery is made to the address specified by the customer when placing his order. It will be carried out by La Poste, UPS or by another carrier. It can only intervene once the order has been validated by the customer and payment made in full.

The bank payment centers that may be concerned will therefore have given their payment agreement in advance. In case of refusal of the said centers, the order will be automatically cancelled.
Furthermore, the Digistore company reserves the right to refuse any order from a customer with whom an ongoing dispute exists.

10 – Delivery time


If the item ordered is available in stock, the shipping time is a maximum of 2 working days (Monday to Friday). For items that are not in stock, the lead time is announced on each product sheet. This time, which depends on the availability at the manufacturers and suppliers, is announced as an indication. This period runs from the effective payment of an order (immediate for instant payments (eg bank card) except in the event of force majeure or exceptional events delaying or prohibiting the delivery of the goods.

In all cases, delivery on time can only occur if the customer is up to date with his obligations to the company.
When receiving a damaged package with a missing or damaged product, the customer must specify his reservations on the delivery note and confirm them, within two days of delivery, by e-mail to Customer Service and by registered mail with AR addressed to the carrier.

11 – Verification of the order upon receipt


By signing the delivery note, the customer accepts the products delivered as they are and therefore no claim relating to damage suffered during transport will be accepted. It is the customer’s responsibility to carry out all checks and make all reservations upon arrival of the equipment and to exercise, if necessary, all recourse against the carrier.

Upon receipt of the goods, the customer must immediately check their condition and their conformity with the order. All complaints relating to a defect in the goods delivered, an inaccuracy in the quantities or an erroneous reference in relation to the Digistore order confirmation, must be made by e-mail to Digistore Customer Service within seven days, failing which the right to claim will cease to be acquired.

Any return request must be made through the return system via the customer area (My account > My returns) with the RMA return number specified on the package. Without a return number, all returned goods will be made available to the customer at his own expense, risk and peril, all transport, storage and handling costs being borne by the customer. In all cases, the return of the goods is carried out at the expense, risk and peril of the customer.

12 – Guarantee and after-sales service


All products sold on the site are guaranteed against manufacturing defects and material defects. All our products benefit from the manufacturer’s warranty, at least two years parts and labor. In the event of a breakdown during the initial warranty period, repairs will be carried out free of charge by the national network of centres, stations or technical agencies approved by the manufacturers. To be able to benefit from the guarantee of the products, it is imperative to keep the purchase invoice of the product.

This warranty does not cover damage resulting from accidents, misuse or negligence. Software malfunctions resulting from misuse are not covered by this warranty, as are mishandling of computer cards (following electrostatic shock).

In the event of the return of equipment proving to be non-defective, costs for handling and diagnosis of €30 including tax including transport costs for the return will be invoiced to the customer.

Any return of goods requires the prior agreement of Digistore and the obtaining of a return number (RMA), which must be legibly written on any returned package. The return of the goods is carried out at the expense, risk and peril of the customer. Products returned by carrier without physical protection or poorly protected cannot benefit from the guarantee, it is therefore up to the customer to take care to protect and insure the product(s) returned for transport.

It is the customer’s responsibility to keep all the packaging and accessories supplied with the product as well as any labels affixed to the product or its packaging, and which are necessary to benefit from the guarantee offered.

Digistore is not the producer of the products presented, within the meaning of law n°98-389 of May 19, 1998 relating to liability for defective products. Consequently, in the event of damage caused to a person or property by a defect in the product, only the responsibility of the producer thereof may be sought by the customer.

Digistore will ensure that the warranty is applied to any returned product as soon as possible. However, when the repair requires the return of the product to the producer, it cannot be held responsible for any delays caused by the producer. On the other hand, the Digistore after-sales service will choose the carrier responsible for delivering the goods to the customer.

Given the manufacturing methods of LCD screens, pixel defects are often unavoidable. They only constitute manufacturing defects if they deviate from the specifications and tolerances announced by the manufacturer.

13 – Right of withdrawal


From the date of delivery of your order, if you are an individual, you have a period of 14 days from the date of receipt of your package, to assert your right of withdrawal and be reimbursed for the total amount. (excluding return costs). Once the agreement has been received by e-mail with the return number, the product concerned must be returned to us within 14 calendar days following receipt of this agreement (postmark or shipping date appearing on the slip making faith) otherwise the return will no longer be accepted.
It is up to the customer to over-pack the original packaging of this (these) product(s) (above all, do not send it as is by writing on it or by sticking the packing slip directly on it), because only the the products returned in their entirety (accessories, manuals, covers, CDs, etc.) and in their original packaging, all of which must be intact and in perfect condition for resale.
Any product that has been damaged, incomplete, soiled or whose original packaging has been damaged, may be subject to a discount.

This right of withdrawal does not apply:

  • to software, as soon as the packaging is opened (unwrapped) or the seal on the cd/dvd sleeve is broken.
  • to computer cards when they have been handled outside their protective sleeve (risk of defect following electrostatic shock) and the seal is broken.
  • external video or audio interfaces for computers supplied with a card/adapter and/or software taken out of its pouch (which may have been used and activated).
  • projectors with a lamp usage time of more than 1 hour (based on projector usage statistics).
  • to bespoke / personalized products for the customer.

This right of withdrawal is exercised without penalty, with the exception of return costs which remain the responsibility of the consumer. In the event of the exercise of the right of withdrawal, the consumer has the choice of requesting either the reimbursement of the sums paid, or an exchange of an amount equivalent to the sums paid or, where applicable, with a bank supplement, the costs re-shipment remaining the responsibility of the consumer.

The company Digistore can in no way be held to compensate following the impossibility of using the purchased product for a reason of incompatibility with the hardware or software already possessed by the customer, it is up to the customer to check the compatibility at the time of the order.

In the event of exercise of the right of withdrawal, Digistore will do its utmost to reimburse the consumer within 15 days.

The consumer will then be reimbursed by re-crediting his bank card in the event of payment with it or by bank transfer in other cases.

14 – Retention of title and liability


The Digistore company retains ownership of the goods until full payment has been received from the customer. The transfer of ownership of the products to the customer takes place at the time of full payment of the price. However, during the period from delivery to transfer of ownership, the risks of loss, theft or destruction are the responsibility of the customer.
Failure by the customer to fulfill his payment obligations, for any reason whatsoever, gives Digistore the right to demand the immediate return of the goods delivered at the customer’s expense and risk. The customer undertakes, in the event of a receivership procedure affecting his Company, to actively participate in the establishment of an inventory of the goods in his stocks and of which the Digistore company claims ownership. Failing this, Digistore has the option of having the inventory recorded by the Bailiff at the customer’s expense. The customer is prohibited from reselling, transforming or incorporating the goods delivered from the date of the judgment pronouncing the receivership or the liquidation of the assets of his Company.

To guarantee the payments not yet made and in particular the balance of the customer’s account in the writings of the company Digistore, it is expressly stipulated that the rights relating to the goods delivered but unpaid will refer to the identical goods from the company Digistore in stock at the customer’s, without the need to allocate payments to a specific sale or delivery.

15 – Data confidentiality

The personal data provided by the customer is not disseminated to third parties.
In accordance with law 78-17 of January 6, 1978, the customer has at any time a right of access and rectification. To exercise this right, simply contact Digistore Customer Service.

16 – Attribution of jurisdiction


The products offered for sale comply with French and European regulations. If necessary, it is up to the foreign customer to check with the local authorities the possibilities of using the product he plans to order. Digistore cannot be held liable in the event of non-compliance with the regulations of a foreign country.
For professional clients, all disputes relating to the formation, execution and termination of contractual obligations between the parties that cannot give rise to an amicable settlement will be subject to the jurisdiction of the Commercial Court of Strasbourg, France in the jurisdiction of which is the headquarters of the company Digistore.
The original language of these conditions of sale is French, in the event of a dispute, only the text in French will be taken into account.
